Custom Rock warrants that formliner products will be free from defects in workmanship or materials for a period of ninety (90) days from the date of purchase. The purchaser must examine the product when received and promptly notify Custom Rock in writing of any nonconformity before the product is used, or no later than 30 days after such nonconformity is first discovered. This warranty is void if the product is altered, tampered with or is installed, or used in a manner that is inconsistent with Custom Rock’s written specifications or Field Service Bulletins as issued from time to time.  ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED.  CUSTOM ROCK IS NOT LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGE, INCLUDING LOSS, DAMAGE, PERSONAL INJURY, OR ANY OTHER EXPENSE DUE TO THE USE OF OR A DEFECT IN THE PRODUCT.  The sole and exclusive remedy is limited to, at Custom Rock’s option, the replacement or repair of the defective product.  If Custom Rock requests the return of defective products, purchaser will pay all transportation costs in returning such products.
